terms and conditions

1. Legal Framework

These terms and conditions are framed by the UK Distance Selling Regulations.

2. Definitions

In these terms and conditions, 'we', 'us' and 'our' means Poetry Pulse. Our office address will be provided to you on our invoice. 'You', 'the client' or 'the customer' means the persons listed on our invoice. If our invoice lists a limited company, 'you', 'the client' or 'the customer' means that company. 'The product' means the goods supplied by us. Poetry Pulse gives notice that these terms and conditions when provided with our invoice comprise the agreement or contract between Poetry Pulse and those listed on our invoice. No representative of Poetry Pulse has the right verbally to vary these terms and conditions or the information within the Poetry Pulse website, or to enter into verbal agreements with customers of Poetry Pulse. By partially or fully paying the invoice the customer is understood to accept our terms and conditions.

3. Order and Payment

Orders can be made through our website or by email and are confirmed only upon payment by you of the full purchase price, including VAT and delivery charges, where relevant. A valid contract comes into existence between us upon our receipt of your payment, and we will at this point send you by email, post or fax these terms and conditions together with our invoice. Payment may be made by credit or debit card or PayPal account via PayPal UK. If you wish to change any detail of your order we will do our best to help, but any change must, of course, be agreed prior to despatch of the product.

4. Supply of Product

We aim to have your product delivered to you within 5 working days (UK & Europe), but we will at the latest supply the products you order within 30 days of our receipt of your payment. If we have to alter the specification of the product, we will advise you as soon as possible, but at the latest within 30 days of our receipt of your payment. You will then have the choice of accepting the alteration, taking an alternative (where this is of a lower price we will refund the difference), or withdrawing from the contract and accepting a full refund of all monies paid.

5. Cancellation by Poetry Pulse

We reserve the right in any circumstances to cancel the agreement to supply the agreed product. If we have to cancel your product we will advise you within 30 days of our receipt of your payment, you will then have the choice of taking an alternative if we are able to offer one (and where this is of a lower price we will refund the difference), or withdrawing from the contract and accepting a full refund of all monies paid.

6. Notice of Cancellation by the Customer

The UK Distance Selling Regulations say that a notice of cancellation will be properly given if the consumer gives notice in one of the following ways:

i. leaving a notice addressed to us at our last address known to the consumer, in which case notice is said to have been given on the day on which it was left at our address ;

ii. posting the notice to us at the address last known to the consumer, in which case notice is said to have been given on the day it was posted; or,

iii. faxing or emailing the notice to us on the last fax number or email address known to the consumer, in which case notice is said to have been given on the day it was sent.

We ask you to keep some evidence of having given us the cancellation notice, such as a certificate of posting or confirmation of fax transmission.

7.Cancellation by the Customer prior to Delivery

You may cancel your order at any time between our receipt of your payment and the despatch of the products. This will constitute withdrawing from the contract and a full refund will be made of all monies paid.

If you wish to cancel your order you must tell us in writing, or in another durable medium. This includes letter, fax or email. A phone call is not enough.

The effective date for cancellations under the UK Distance Selling Regulations is the date on which you give notice of cancellation to Poetry Pulse.

You can cancel an order before you receive the goods or where goods are lost in transit. Under the UK Distance Selling Regulations your right is unconditional. If you cancel before you have received the goods we must refund the total price of the goods, including any delivery charges. Consumers who have cancelled under the UK Distance Selling Regulations may refuse to accept delivery of the goods. Refusal in such a situation cannot be treated as a breach of contract.

Where goods are lost in transit from us to you, we will either send replacement goods or offer you a full refund, including delivery charges.

8. Returns by the Customer

You may return the products we supply to you within seven days after the date of delivery to you of the products we supply. You will be required to pay the postage charge for any goods you return, and we will refund all other monies paid by you within 30 days of our receipt of your notice of cancellation.

9. Complaints

In the unlikely event that any Poetry Pulse product is not up to the standard as outlined in the agreed specifications, a complaint should be made in writing within 30 days of the date of delivery. Failure to do this may reduce or extinguish any rights you may have to claim compensation from Poetry Pulse or any of its suppliers.

10. Website Description

We reserve the right to change any of the prices, products, services or other particulars contained on Poetry Pulse website before we enter into a contract with you. If there is any change, we will advise you before we enter into such a contract. Please note that photographs used on the website and in promotional material are only used as examples and actual products may differ.

11. Law and Jurisdiction

The contract is governed by English Law with any action arising out of it being subject to the exclusive jurisdiction of the courts of England and Wales.
